GENERAL TERMS AND CONDITIONS OF SALE

1. Purpose

These General Terms and Conditions of Sale (hereinafter "GTC") govern the contractual relationship between the company

hereinafter referred to as "the Seller", and any professional or consumer customer, hereinafter referred to as "the Customer", concerning the sale of products and tools intended for the trades of jewelry, goldsmithing and medicine.

2. Scope

These Terms and Conditions apply to all sales made by the Seller via its website, by post or by any other means.

Placing an order implies unconditional acceptance of these Terms and Conditions.

3. Products

The essential characteristics of the products are described on the website and/or in the catalogues.

Photographs and descriptions are provided for information purposes only and are not contractually binding.

4. Prices

Prices are quoted in euros excluding VAT (excl. VAT) and including all taxes (incl. VAT) in accordance with applicable regulations. Prices are provided to the customer upon written request.

The Seller reserves the right to amend its prices at any time, but products are invoiced on the basis of the price list in force at the time of the order.

5. Orders

Orders may be placed:

  • via the website

  • by email or by signed purchase order.

All orders become firm and final upon written confirmation by the Seller.

6. Terms of payment

Payment shall be made:

  • by bank transfer,

  • by credit card,

  • or by any other means accepted by the Seller.

Unless otherwise specified, payment is due upon placing the order.

In the event of late payment, late payment penalties and a fixed compensation for recovery costs may be applied in accordance with French law.

7. Delivery

Delivery times are given for information purposes only.

Risk passes to the Customer upon delivery of the products.

8. Returns and Refunds

Products must be returned in their original condition and complete.

Return costs are the responsibility of the Customer unless there is a lack of conformity or an error on the part of the Seller.

9. Statutory warranties

The Seller is obliged:

 

General Warranty Terms and Conditions – Techdent

9.1. Scope of the warranty

Techdent products are guaranteed against any defect in materials, workmanship or operation under the conditions set out below. The warranty applies exclusively to products marketed under the Techdent brand and used in accordance with their intended purpose.

9.2. Duration of the warranty

  • Micromotors, suspended motors and handpieces: 24-month warranty from the date of purchase.

  • Accessories, cables, clamps, consumables: 6-month warranty.

  • Batteries and mesotherapy wear parts: 6-month warranty, unless otherwise stated.

The date shown on the purchase invoice shall be deemed valid.

9.3. Scope of the warranty

The warranty covers:

  • Defects in workmanship or materials.

  • Failures resulting from normal use of the product.

  • Replacement or repair of defective parts.

  • Labour and testing prior to return to service.

Repairs carried out under the warranty do not extend the warranty period.

9.4. Warranty exclusions

The warranty does not cover:

9.4.1. Misuse

  • Use not in accordance with the manual or technical specifications.

  • Use of the product in an unsuitable environment (humidity, excessive dust, aggressive solvents, etc.).

  • Impacts, drops, crushing, mechanical damage.

 

9.4.2. Unauthorised work

  • Repairs, modifications or dismantling carried out by a third party not authorised by Techdent.

  • Use of non-original spare parts.

9.4.3. Normal wear and tear

  • Clamps, bearings, seals, carbon brushes (if DC motors), cables, spindles.

  • Cosmetic damage not affecting operation.

 

9.4.4. External damage

  • Power surges, power supply faults, lightning strikes.

  • Immersion in liquid.

  • Corrosion due to unsuitable storage.

9.5. Conditions of warranty coverage

To benefit from the warranty, the customer must provide:

  • The original purchase invoice.

  • The product’s serial number.

  • A detailed description of the fault observed.

Techdent reserves the right:

  • To inspect the product before accepting the claim.

  • To refuse the warranty if the above conditions are not met.

  • To provide a quote if the fault is not covered.

9.6. Terms of cover

Depending on the nature of the fault, Techdent may:

  • Repair the product.

  • Replace it with an identical or equivalent product.

  • Issue a refund if repair is not possible.

The cost of sending the product to Techdent is the customer’s responsibility. Return costs are covered by Techdent if the warranty claim is accepted.

9.7. Limitation of liability

The Techdent warranty does not cover:

  • Business interruption, indirect or consequential damages.

  • Damage caused to other equipment connected to the product.

  • The consequences of intensive professional use not in accordance with the recommendations.

9.8. Products outside the warranty period

For products not covered or outside the warranty period, Techdent offers:

  • A paid repair service.

  • A mandatory prior quote.

  • The option of replacement with a refurbished product.

 

9.9. Final provisions

These terms and conditions may be amended without notice. The contractual warranty applies without prejudice to the consumer’s statutory rights.

10. Liability

The Seller shall not be held liable for any indirect damage resulting from the use of the products.

The Seller’s liability is limited to the amount of the order.

11. Force majeure

Neither party shall be held liable if the performance of the contract is delayed or prevented by a case of force majeure as defined by French case law.

12. Applicable law and disputes

These T&Cs are governed by French law.

In the event of a dispute, an amicable solution shall be sought before any legal action is taken.

Failing this, the competent courts shall be those of the Seller’s registered office.

13. Distributors and resellers

Specific commercial terms (discounts, volumes, territorial exclusivity) shall be the subject of a separate contract between the Seller and the distributor, which shall take precedence over these GTC.
