Returns, claims and refunds
1. Scope
These General Terms and Conditions of Sale ( below "GTC”) apply exclusively to sales of products made by the Seller to business customers acting in the course of their commercial, industrial, craft or professional activities, in particular distributors and resellers of tools and equipment intended for the jewellery and medical sectors.
Sales are governed by the French Civil Code and the French Commercial Code. The provisions of the French Consumer Code relating to consumers do not apply, unless otherwise required by mandatory legal provisions.
2. No right of withdrawal
In accordance with Article L221-3 of the French Consumer Code, the right of withdrawal does not apply to contracts concluded between professionals, provided that the subject matter of the contract falls within the scope of the customer’s main business activity.
Consequently, any confirmed order is firm and final, and may not be subject to any unilateral cancellation or withdrawal.
3. Complaints – Non-compliant or defective products
The Customer is required to check the condition and conformity of the products upon receipt.
Any complaint regarding a product that is defective, damaged or does not comply with the order must be made in writing within a maximum of 7 working days from receipt of the products.
After this period, the products will be deemed to be compliant and free from any apparent defects.
4. Returns procedure

The request must include the following information:

order number;
-
product reference and quantity;
-
a detailed description of the reason for the request;

where applicable, photographs enabling the non-conformity or defect to be assessed.
No return may be made without the Seller’s prior written consent.
5. Return conditions
If the Seller accepts the return, the products must be returned:
-
in their original condition, unused;
-
in their original packaging, complete and undamaged;
-
accompanied by all accessories, instructions and documents supplied.
Products returned incomplete, damaged, used or soiled will not be accepted or refunded.
6. Costs and risks associated with returns
Unless the error is attributable to the Seller or the product is recognised as defective, the costs and risks associated with returning the products shall be borne exclusively by the Customer.
The Seller shall not be held liable in the event of loss, theft or damage to the products during return transport.
7. Refund or replacement procedures
Upon receipt and inspection of the returned products, the Seller reserves the right, at its sole discretion:

to replace the products;

to issue a full or partial refund;

to issue a credit note to be used on a future order.
No cash refund may be claimed by the Customer.
8. Products excluded from return
Unless the Seller has given prior written consent, the following are excluded from return, exchange or refund:

products that are personalised or made to specific order;
-
products that have been used;
-
products damaged as a result of mishandling, negligence or alteration by the customer.
9. Limitation of liability
The Seller’s liability is strictly limited to the pre-tax value of the products concerned. Under no circumstances shall the Seller be held liable for indirect damages, operating losses, loss of turnover or loss of customers.
